A proper notification releases you from defect liability to that extent (\u00a7 13(3) VOB\/B). Under a BGB contract comparable principles apply via inspection and warning duties.<\/p>\n<p>In court it is the contractor who must prove that the concerns were properly notified \u2014 without that proof he is liable for the defect even where the design or the customer&#8217;s material caused it. More on who proves what in our article on <a href=\"https:\/\/bwlaw.de\/en\/knowledge-base\/construction-defects-burden-of-proof-germany\/\">the burden of proof for construction defects<\/a>.<\/p>\n      <h3 style=\"font-size:1.35rem;margin-top:2.2rem\">How to notify effectively<\/h3>\n      <ul>\n        <li>in writing and to the right addressee \u2014 the customer, not just the foreman of the preceding trade,<\/li>\n        <li>concretely: what raises concerns, what consequences loom, what solution you propose,<\/li>\n        <li>before executing the affected work \u2014 a notice given afterwards does not protect,<\/li>\n        <li>with proof of receipt \u2014 this document wins lawsuits.<\/li>\n      <\/ul>\n      <h3 style=\"font-size:1.35rem;margin-top:2.2rem\">Concerns and stopping work<\/h3>\n      <p>The notification alone does not always justify a stop: if the customer orders continuation, work generally continues \u2014 and responsibility passes to them.
